To handle appeals from the decisions of the Insurance Regulatory Authority. Any member of the public who is dissatisfied with the decision of the Authority may appeal such decision to the tribunal.
- On appeal, the Tribunal may set aside the decision of the Insurance Regulatory Authority, vary it or refer it back to the authority for reconsideration.
- In performing its function, the Tribunal shall have power to;
- Take evidence on oath
- Proceed in the absence of a party who has had reasonable notice of proceedings.
- Adjourn the hearing of proceedings.
- Make an order as to costs against any party which shall be enforceable like an order of the High Court.
- Examine any witness who is outside Uganda.
- The Members of the tribunal are appointed by the Minister of Finance, Economic Planning and Development.
- The Minister also, in consultation with the Judicial Service Commission, appoints a chairperson of the Tribunal who must be a person qualified to be judge of the High Court.
- The Tribunal, in consultation with the Judicial Service Commission, appoint the Registrar of the Tribunal who must be a person qualified to be a registrar of the High Court.
- The Tribunal has the power to hire other employees for the smooth running of the secretariat.
The Tribunal is fully constituted for proceedings by at least three (3) members present.
The Tribunal only has appellate jurisdiction from the decision of the Insurance Regulatory Authority. A party to an insurance policy or any third party with a legal grievance arising out of activity by any person licensed by the Insurance Regulatory Authority may complain to the Complaints Bureau of the Insurance Regulatory Authority. If, the complainant is not satisfied with the decision of the authority, then he or she may appeal to the Tribunal. Where Licensees such as Insurance companies, Health Membership Organizations (HMOs), Brokers aggrieved by any action or decision taken by the authority, may apply to the Tribunal to review such a decision.
A person aggrieved by the decision of the authority must bring his/her appeal to the tribunal within one month from the date of the decision. Upon lodgment of the Appeal, the tribunal will schedule a date for the hearing of the appeal. A decision of the Tribunal shall be in writing and shall be communicated within 90 days after an appeal is made to the Tribunal.
A party aggrieved by the decision of the tribunal may, within 30 days from the date of delivering the decision, appeal to the High Court.
The tribunal is located on the 7th Floor of Rumee Tower on plot 19 Lumumba Avenue.
The Tribunal is open from Monday to Friday between 8:00 to 5:00 pm
